A todo, 62 pessoas morreram.<\/p>\n<p>A a\u00e7\u00e3o come\u00e7ou a ser julgada em 2021 no plen\u00e1rio virtual. Na ocasi\u00e3o, o ministro Nunes Marques votou pela constitucionalidade da Lei 12.970\/2014, que alterou o C\u00f3digo Brasileiro de Aeron\u00e1utica (CBA) e estabeleceu as medidas questionadas. Ap\u00f3s o voto do ministro, que \u00e9 relator do caso, o julgamento foi suspenso por um pedido de vista do ministro Alexandre Moraes.<\/p>\n<h2>Sem puni\u00e7\u00e3o<\/h2>\n<p>Os questionamentos ocorrem porque as investiga\u00e7\u00f5es realizadas pelo Centro de Investiga\u00e7\u00e3o e Preven\u00e7\u00e3o de Acidentes Aeron\u00e1uticos (Cenipa) servem para preven\u00e7\u00e3o de outros acidentes, ou seja, n\u00e3o t\u00eam prop\u00f3sito de punir os envolvidos.<\/p>\n<p>Por outro lado, o Minist\u00e9rio P\u00fablico e a Pol\u00edcia Federal (PF) buscam a responsabiliza\u00e7\u00e3o criminal de eventuais irregularidades cometidas pelos fabricantes das aeronaves, pilotos, mec\u00e2nicos e companhias a\u00e9reas.<\/p>\n<p>O principal ponto questionado pela PGR trata da finalidade da investiga\u00e7\u00e3o conduzida pelo Cenipa. Conforme a lei, a investiga\u00e7\u00e3o realizada pela Aeron\u00e1utica n\u00e3o pode ser utilizada para fins probat\u00f3rios em processos judiciais e administrativos.
