A medida representa a principal estrat\u00e9gia do governo do presidente Luiz In\u00e1cio Lula da Silva para enfrentar as organiza\u00e7\u00f5es criminosas e prev\u00ea a cria\u00e7\u00e3o de um minist\u00e9rio dedicado \u00e0 seguran\u00e7a p\u00fablica ap\u00f3s a promulga\u00e7\u00e3o da emenda.<\/p>\n<p>A PEC foi aprovada na C\u00e2mara dos Deputados em mar\u00e7o deste ano e teve sua an\u00e1lise finalizada na Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a (CCJ) do Senado em 14 de outubro.<\/p>\n<h2>A PEC<\/h2>\n<p><strong>Dentre as inova\u00e7\u00f5es, a PEC prop\u00f5e a inclus\u00e3o do Sistema \u00danico de Seguran\u00e7a P\u00fablica (SUSP) na Constitui\u00e7\u00e3o, alterando o Artigo 144 da Constitui\u00e7\u00e3o Federal, que atualmente rege a seguran\u00e7a p\u00fablica.<\/strong><\/p>\n<p>O texto afirma que a seguran\u00e7a deve ser exercida \u201cem regime de coopera\u00e7\u00e3o federativa\u201d e \u201cpor meio da atua\u00e7\u00e3o integrada e descentralizada\u201d das diferentes institui\u00e7\u00f5es envolvidas. A proposta estabelece que \u201cArt. 144-A. Os \u00f3rg\u00e3os de seguran\u00e7a p\u00fablica articular-se-\u00e3o em regime de coopera\u00e7\u00e3o federativa, por meio do Sistema \u00danico de Seguran\u00e7a P\u00fablica, destinado a assegurar a efici\u00eancia da preven\u00e7\u00e3o, da persecu\u00e7\u00e3o e da execu\u00e7\u00e3o penal\u201d.<\/p>\n<h2>Fac\u00e7\u00f5es e mil\u00edcias<\/h2>\n<p><strong>A PEC tamb\u00e9m prev\u00ea penas mais severas para os chefes de fac\u00e7\u00f5es e mil\u00edcias, restringindo ou impedindo a progress\u00e3o de regime para esses l\u00edderes, que dever\u00e3o cumprir suas penas em unidades de seguran\u00e7a m\u00e1xima.<\/strong><\/p>\n<p>Al\u00e9m disso, a proposta inclui medidas patrimoniais contra os produtos do crime, responsabiliza\u00e7\u00e3o de empresas envolvidas e prote\u00e7\u00e3o aos denunciantes e suas fam\u00edlias. Outra pauta inovadora da PEC \u00e9 a cria\u00e7\u00e3o de pol\u00edcias municipais civis, que estar\u00e3o sob a supervis\u00e3o do Minist\u00e9rio P\u00fablico, com a responsabilidade de realizar policiamento ostensivo e comunit\u00e1rio nas cidades.<\/p>\n<p>A PEC ainda promete ampliar as atribui\u00e7\u00f5es da Pol\u00edcia Rodovi\u00e1ria Federal (PRF), prev\u00ea a cria\u00e7\u00e3o de novas pol\u00edcias municipais e aumentar a destina\u00e7\u00e3o or\u00e7ament\u00e1ria \u00e0 seguran\u00e7a p\u00fablica.<\/p>\n<p>Al\u00e9m disso, a proposta estabelece um Sistema de Pol\u00edticas Penais que gerenciar\u00e1 o sistema prisional do Brasil e permite que a Uni\u00e3o, estados e munic\u00edpios atuem juntos na elabora\u00e7\u00e3o de legisla\u00e7\u00f5es sobre seguran\u00e7a p\u00fablica, organiza\u00e7\u00e3o das pol\u00edcias, guardas municipais e sistema socioeducativo.<\/p>\n<h2>Fundos de financiamento<\/h2>\n<p><strong>Conforme descrito na PEC, 50% dos recursos do Fundo Nacional de Seguran\u00e7a P\u00fablica (FNSP) e do Fundo Penitenci\u00e1rio Nacional (Funpen) dever\u00e3o ser repassados pela Uni\u00e3o a estados e munic\u00edpios, excluindo despesas permanentes e investimentos da pol\u00edcia penitenci\u00e1ria nacional do Funpen.<\/strong><\/p>\n<blockquote>\n<p>\u201cAs regras de financiamento fortalecem o FNSP e o Funpen, criando vincula\u00e7\u00f5es or\u00e7ament\u00e1rias que garantem repasses obrigat\u00f3rios.
