O r\u00e9u foi <strong>absolvido da acusa\u00e7\u00e3o de homic\u00eddio duplamente qualificado<\/strong>. O caso ocorreu em 2014, quando ap\u00f3s uma forte discuss\u00e3o, o modelo deu um golpe de skate na cabe\u00e7a do grafiteiro, que ficou em coma por um traumatismo craniano e morreu 12 dias depois. A acusa\u00e7\u00e3o afirma que ir\u00e1 recorrer.<\/p>\n<p>O julgamento aconteceu no F\u00f3rum de S\u00e3o Vicente e Eloy responde ao processo em liberdade e foi julgado por homic\u00eddio duplamente qualificado, por motivo f\u00fatil e recurso que dificultou a defesa da v\u00edtima.<\/p>\n<div class=\"content-ads content-ads--reveal\" data-block-type=\"ads\" data-block-id=\"4\"><\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"36\" data-block-id=\"5\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">No total, sete testemunhas compareceram ao j\u00fari, que aconteceu nesta ter\u00e7a (30). Ap\u00f3s cerca de 17 horas de julgamento, o Tribunal do J\u00fari, composto por seis mulheres e um homem, votou pela absolvi\u00e7\u00e3o do r\u00e9u. A tese de defesa de Eloy, feita pelo advogado M\u00e1rio Badures, se baseou em ato de leg\u00edtima defesa, pois Leto estaria agressivo e teria partido para cima do modelo e, tamb\u00e9m, no laudo m\u00e9dico que apontou que o traumatismo craniano da v\u00edtima estava localizado no lado oposto ao golpe.<\/p>\n<p data-track-category=\"Link no Texto\" data-track-links=\"\">Segundo Badures, antes do julgamento, que exames periciais apontaram que o ferimento que causou a morte de Leto foi feito quando ele caiu no ch\u00e3o, e n\u00e3o no golpe de skate. &#8220;N\u00e3o s\u00f3 a prova oral, mas o apoio da prova pericial demonstra que o skate foi usado como escudo. Onde o skate atinge o rosto do Leto, o traumatismo craniano est\u00e1 situado no lado oposto&#8221;, falou.<\/p>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"70\" data-block-id=\"8\">\n<div class=\"mid-mc-placeholder\">O advogado Darcio C\u00e9sar Marques, que atua como assistente de acusa\u00e7\u00e3o, disse que a decis\u00e3o foi &#8220;completamente contr\u00e1ria \u00e0s provas dos autos&#8221;. Ele garante que ir\u00e1 recorrer da decis\u00e3o.<\/div>\n<\/div>\n<\/div>\n<h3>A morte de Leto<\/h3>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"39\" data-block-id=\"13\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Leto foi morto com um golpe de skate durante uma discuss\u00e3o com o modelo no bairro Catiapo\u00e3, em S\u00e3o Vicente. Ele fazia uma pintura no muro de uma resid\u00eancia quando recebeu o golpe na cabe\u00e7a, sem aparente justificativa.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"55\" data-block-id=\"14\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Segundo os laudos m\u00e9dicos da \u00e9poca, o grafiteiro teve afundamento do cr\u00e2nio,\u00a0foi colocado em coma induzido e morreu dias depois. Eloy se apresentou no 1\u00b0 Distrito Policial de S\u00e3o Vicente uma semana antes, afirmando que atacou Leto apenas para se defender.\u00a0Uma testemunha chegou a afirmar que o modelo tinha a inten\u00e7\u00e3o de machuc\u00e1-lo.<\/p>\n<\/div>\n<div class=\"content-ads content-ads--reveal\" data-block-type=\"ads\" data-block-id=\"15\"><\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"60\" data-block-id=\"16\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Em depoimento foi descoberto que os dois j\u00e1 se conheciam. O delegado Marcos Alexandre Alfino, respons\u00e1vel pelas investiga\u00e7\u00f5es, disse na \u00e9poca que o modelo afirmou que ele tinha ido a um est\u00fadio de tatuagem para fazer um desenho e que Leto trabalhava no local.
