Ele \u00e9 determinado pela ag\u00eancia reguladora. O que a Justi\u00e7a ir\u00e1 debater, nesta quarta-feira, \u00e9 se essa determina\u00e7\u00e3o \u00e9 taxativa ou exemplificativa.<\/p>\n<p>Ou seja, o STJ decidir\u00e1 \u00e9 se as operadoras de planos de sa\u00fade s\u00e3o obrigadas ou n\u00e3o a custearam tratamentos de seus usu\u00e1rios. O que isso significa \u00e9 se elas t\u00eam a obrigatoriedade de realizarem exames e cirurgias, mesmo\u00a0 mesmo que solicitados pelos m\u00e9dicos dos pacientes, mas que n\u00e3o estejam dentro do rol de procedimentos obrigat\u00f3rios.<\/p>\n<p>Para Adilton Garcia, advogado e ex-diretor do Programa de Defesa ao Consumidor (Procon) de Jundia\u00ed, este \u00e9 um debate muito importante. Para ele, se o STJ negar aos usu\u00e1rios dos planos de sa\u00fade a utiliza\u00e7\u00e3o de eventos fora do rol de procedimentos, isso poder\u00e1 prejudica-los, al\u00e9m de sobrecarregar o Sistema \u00danico de Sa\u00fade (SUS).
