Um homem foi preso em Palmas, Capital do Tocantins, acusado de dar calote<\/strong>. Ele se tornou famoso por fazer o consumo em bares e restaurantes, mas n\u00e3o pagava as contas. Uma destas ocorr\u00eancias foi em Ilhabela<\/a>, onde ele causou um preju\u00edzo de R$ 1,8 mil a um quiosque.<\/p>\n

O suspeito foi identificado como Ruan Pamponet Costa, que foi preso na quinta-feira (21). Ele deu um calote de R$ 5,2 mil em um estabelecimento em Palmas. O crime aconteceu apenas dois dias ap\u00f3s o investigado sair da cadeia em Goi\u00e2nia (GO) por aplicar o mesmo golpe\u00a0e causar um preju\u00edzo de R$ 6 mil.<\/p>\n

O caso em\u00a0Ilhabela\u00a0ocorreu antes de ele\u00a0ficar conhecido nacionalmente pelos golpes, em outubro de 2020. Ruan chegou ao quiosque acompanhado de duas jovens e juntos consumiram bebidas caras, como whisky, vodka e tequila, al\u00e9m de pratos como camar\u00e3o, lula e fil\u00e9 mignon. Ap\u00f3s o consumo, as jovens que o acompanharam deixaram o local e ele disse que n\u00e3o pagaria a conta.<\/p>\n

O dono do quiosque no litoral paulista chamou a Pol\u00edcia Militar e ao ser abordado pelos policiais, Ruan se negou a apresentar um documento de identifica\u00e7\u00e3o. Ele tamb\u00e9m n\u00e3o forneceu nenhum dado e disse que queria ser levado para a delegacia.<\/p>\n

De acordo com o boletim de ocorr\u00eancia registado sobre o caso, em v\u00e1rios momentos ele disse “ser malandro”, insinuando que era uma pr\u00e1tica comum.<\/p>\n

O delegado Leandro Reis da Silva, respons\u00e1vel pelo caso, contou como era a postura e a forma como ele aplicava os golpes.<\/p>\n

“O que pude perceber \u00e9 que ele j\u00e1 conhece o sistema policial, como funciona a lei e principalmente o crime que ele estava cometendo, que \u00e9 o do artigo 176. Esse crime \u00e9 de pequeno potencial ofensivo, diferente do estelionato, que j\u00e1 seria de m\u00e9dio. Mas para configurar estelionato ele precisa enganar a pessoa para conseguir vantagem”, disse o delegado.<\/p><\/blockquote>\n<\/div>\n

O artigo 176 do C\u00f3digo Penal define como crime a pr\u00e1tica de “tomar refei\u00e7\u00e3o em restaurante, alojar-se em hotel ou utilizar-se de meio de transporte sem dispor de recursos para efetuar o pagamento”. A pena pode ir da pris\u00e3o de 15 dias a dois meses ou pagamento de multa. A libera\u00e7\u00e3o ocorre mediante a assinatura de um termo circunstanciado, que \u00e9 um registro oficial deste tipo de crime.<\/p>\n

Defesa<\/h3>\n

Em entrevista ao Fant\u00e1stico, da TV Globo, o advogado de defesa disse que o crime cometido por ele n\u00e3o pode ser enquadrado no artigo 171, de estelionato. Mas sim, no artigo 176, que \u00e9 de menor potencial ofensivo. Alega, portanto, que Ruan n\u00e3o deve estar recluso no sistema prisional.<\/p>\n

O advogado ainda explicou que existe a possibilidade de que ele fa\u00e7a um exame psicossocial para entender melhor a quest\u00e3o.<\/p>\n

“Estava conversando com ele antes de iniciar a audi\u00eancia de cust\u00f3dia. N\u00e3o ficou muito claro at\u00e9 pelo tempo que tivemos para conversar. Foi dado o tempo, mas fiquei mais apegado a colher as informa\u00e7\u00f5es e fazer a defesa t\u00e9cnica dele. Num momento posterior, seria interessante a gente ver a quest\u00e3o de solicitar algum perito para fazer um exame psicossocial, para ver se existe algum dist\u00farbio. Mas isso \u00e9 algo que a defesa vai analisar, vou conversar com o Ruan em outro momento para ver se existe essa possibilidade, se existe algum dist\u00farbio… Vou ver com a fam\u00edlia tamb\u00e9m\u201d, afirmou.<\/p>\n
