Ele exige que seja paga uma indeniza\u00e7\u00e3o de R$ 180 mil em raz\u00e3o do uso indevido da imagem e por n\u00e3o dar os devidos cr\u00e9ditos, al\u00e9m dos danos materiais e morais. A administra\u00e7\u00e3o nega as acusa\u00e7\u00f5es e garante que d\u00e1 sim o cr\u00e9dito ao autor.<\/p>\n<p>Segundo o documento da Vara da Fazenda P\u00fablica, o artista alega que a obra foi cedida para a Secretaria de Turismo da cidade para uma temporada de curta dura\u00e7\u00e3o, at\u00e9 meados de agosto de 2012.<\/p>\n<p>Ainda de acorco com a a\u00e7\u00e3o judicial, o artista alega que ofereceu a est\u00e1tua para a prefeitura e para a empresa que administrava o Museu Pel\u00e9 para compra ou loca\u00e7\u00e3o da obra, mas teria sido informado que a verba era insuficiente para a transa\u00e7\u00e3o. Atualmente, o munic\u00edpio \u00e9 o \u00fanico respons\u00e1vel pelo equipamento tur\u00edstico.<\/p>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"43\" data-block-id=\"6\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">La\u00e9rcio Alves declarou \u00e0 Justi\u00e7a que n\u00e3o autorizou a exposi\u00e7\u00e3o da obra ou acertou qualquer valor relacionado com a sua utiliza\u00e7\u00e3o [loca\u00e7\u00e3o]. \u00c0 reportagem, a\u00a0<span class=\"highlight highlighted\">prefeitura informou que a pe\u00e7a sempre esteve \u00e0 disposi\u00e7\u00e3o do autor, que nunca foi retir\u00e1-la do museu.<\/span><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"25\" data-block-id=\"7\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">No documento, consta que o munic\u00edpio teria divulgado a obra de Pel\u00e9 em site oficial e redes sociais. Tais publica\u00e7\u00f5es, por\u00e9m, n\u00e3o foram encontradas.<\/p>\n<h3 data-track-category=\"Link no Texto\">Defesa da Prefeitura<\/h3>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"41\" data-block-id=\"10\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Em nota, a Prefeitura de Santos garante que o museu fez diversos contatos recentes com a advogada do artista para informar que <span class=\"highlight highlighted\">a obra n\u00e3o est\u00e1 mais sendo exposta\u00a0<\/span>e para ratificar que\u00a0<span class=\"highlight highlighted\">o artista pode retir\u00e1-la quando quiser<\/span>, situa\u00e7\u00e3o que nunca ocorreu.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"35\" data-block-id=\"11\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><span class=\"highlight highlighted\">A prefeitura destaca, ainda, que a obra foi cedida gratuitamente para exposi\u00e7\u00f5es tempor\u00e1rias no munic\u00edpio, antes mesmo do Museu Pel\u00e9 ser inaugurado, em 2014<\/span>. Portanto, n\u00e3o teria rela\u00e7\u00e3o direta com o acervo do espa\u00e7o museol\u00f3gico.<\/p>\n<p data-track-category=\"Link no Texto\" data-track-links=\"\">&#8220;Vale ressaltar que\u00a0<span class=\"highlight highlighted\">a est\u00e1tua est\u00e1 guardada em local seguro<\/span>.
