Quem for pego praticando o delito poder\u00e1 ser preso pela autoridade policial.<\/p>\n<p>A regra e as exce\u00e7\u00f5es constam no Artigo 236 do C\u00f3digo Eleitoral (Lei 4.737\/1965). A l\u00f3gica do dispositivo, herdado de normas eleitorais antigas, \u00e9 impedir que alguma autoridade utilize seu poder de pris\u00e3o para interferir no resultado das elei\u00e7\u00f5es. O artigo \u00e9 o mesmo\u00a0que veda a\u00a0<a href=\"https:\/\/agenciabrasil.ebc.com.br\/politica\/noticia\/2022-09\/nenhum-candidato-podera-ser-preso-partir-deste-sabado\" target=\"_blank\" rel=\"noopener\">pris\u00e3o de candidatos<\/a>, fiscais eleitorais, mes\u00e1rios e delegados de partidos nos 15 dias que antecedem o pleito.<\/p>\n<p>A veda\u00e7\u00e3o n\u00e3o se aplica a quem for pego cometendo crime, ou logo depois de comet\u00ea-lo. Isso inclui crimes eleitorais.
