O Tribunal de Justi\u00e7a do Estado de S\u00e3o Paulo (TJ-SP) negou o requerimento da Comiss\u00e3o de Direitos e Prerrogativas da Ordem dos Advogados do Brasil (OAB-SP) para que o procurador <strong>fosse transferido para uma sala de estado maior<\/strong>, que n\u00e3o tem grades e portas trancadas por fora.<\/p>\n<\/div>\n<\/div>\n<div class=\"wall protected-content\">\n<div id=\"chunk-upik\">\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"42\" data-block-id=\"4\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Na decis\u00e3o desta quarta-feira (23), o juiz Raphael Ernane Neves defendeu que n\u00e3o \u00e9 necess\u00e1ria a transfer\u00eancia. ele entende que conforme informa\u00e7\u00f5es prestadas pela Secretaria de Administra\u00e7\u00e3o Penitenci\u00e1ria (SAP), Dem\u00e9trius encontra-se em ala separada e em instala\u00e7\u00f5es adequadas \u00e0 condi\u00e7\u00e3o de advogado.<\/p>\n<\/div>\n<\/div>\n<div id=\"chunk-blg37\">\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"49\" data-block-id=\"6\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">&#8220;Nessa linha, sendo garantida a perman\u00eancia em local condigno e separado, como no caso, tenho que respeitada a regra do art. 7\u00ba, V da lei 8.906\/94, n\u00e3o havendo necessidade de se efetuar transfer\u00eancia de estabelecimento, menos ainda, de concess\u00e3o de pris\u00e3o domiciliar&#8221;, pontuou o juiz em sua decis\u00e3o.<\/p>\n<\/div>\n<\/div>\n<div id=\"chunk-a3mcg\">\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"23\" data-block-id=\"7\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A defesa de Dem\u00e9trius, n\u00e3o se manifestou sobre o tema. Enquanto isso, a defesa de Gabriela e o Minist\u00e9rio P\u00fablico do Estado de S\u00e3o Paulo (MP-SP) s\u00e3o contra a transfer\u00eancia e t\u00eam se articulado para que ela n\u00e3o ocorra.
