Isto inclui a dom\u00e9stica, das atividades de trabalho durante o per\u00edodo de pandemia. O texto determina o retorno presencial de trabalhadoras gr\u00e1vidas ap\u00f3s a conclus\u00e3o do esquema vacinal contra a Covid-19, com duas doses ou dose \u00fanica (no caso da vacina da Janssen).<img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1447005&amp;o=node\" \/><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1447005&amp;o=node\" \/><\/p>\n<p>A medida foi aprovada de forma definitiva pelo Congresso Nacional em fevereiro, modificando uma lei que estava em vigor desde o ano passado. Nela havia a garantia \u00e0s mulheres gr\u00e1vidas o afastamento do trabalho presencial sem preju\u00edzo do sal\u00e1rio.<\/p>\n<p>A nova lei, que ser\u00e1 publicada no <a href=\"https:\/\/www.in.gov.br\/servicos\/diario-oficial-da-uniao\">Di\u00e1rio Oficial<\/a> de quinta-feira (10), estabelece as hip\u00f3teses em que o retorno ao regime presencial \u00e9 obrigat\u00f3rio para mulheres gr\u00e1vidas. S\u00e3o em caso do encerramento do estado de emerg\u00eancia; ap\u00f3s a vacina\u00e7\u00e3o (a partir do dia em que o Minist\u00e9rio da Sa\u00fade considerar completa a imuniza\u00e7\u00e3o); se ela se recusar a se vacinar contra o novo coronav\u00edrus, com termo de responsabilidade; ou se houver aborto espont\u00e2neo com recebimento do sal\u00e1rio-maternidade nas duas semanas de afastamento garantidas pela Consolida\u00e7\u00e3o das Leis do Trabalho (CLT).<\/p>\n<p>O afastamento do trabalho presencial s\u00f3 continua mantido para a mulher que ainda n\u00e3o tenha completado o ciclo vacinal.<\/p>\n<p>O texto considera que a op\u00e7\u00e3o por n\u00e3o se vacinar \u00e9 uma \u201cexpress\u00e3o do direito fundamental da liberdade de autodetermina\u00e7\u00e3o individual\u201d. Segundo a medida, caso decida por n\u00e3o se imunizar, a gestante deve assinar um termo de responsabilidade e livre consentimento para o exerc\u00edcio do trabalho presencial.<\/p>\n<h3>Regras<\/h3>\n<p>Para os casos em que as atividades presenciais da trabalhadora n\u00e3o possam ser exercidas remotamente, ainda que se altere suas fun\u00e7\u00f5es, respeitadas suas compet\u00eancias e condi\u00e7\u00f5es pessoais, a situa\u00e7\u00e3o deve ser considerada como gravidez de risco at\u00e9 a gestante completar a imuniza\u00e7\u00e3o e poder retornar ao trabalho presencial.<\/p>\n<p>Durante esse per\u00edodo, ela deve receber o sal\u00e1rio-maternidade desde o in\u00edcio do afastamento at\u00e9 120 dias ap\u00f3s o parto. Mas tamb\u00e9m se a empresa fizer parte do programa Empresa Cidad\u00e3 de extens\u00e3o da licen\u00e7a, por 180 dias.
